PRIVACY POLICY and TERMS OF USE

I am committed to protecting your privacy and strive to work in accordance with new privacy laws worldwide.  I operate primarily from my home location in British Columbia Canada although most of my sales and customers are internationally based and conduct business with me online.  I do not distribute or share any personal information from viewers and customers of my websites unless it is mandated by legal process.  In order to run an online business I use Squarespace as my web provider, STRIPE which processes payments for items ordered from this website, Mailchimp to administer my mailing list and Etsy to administer print sales.  Each of these parties strive to be compliant with privacy laws including the General Data Protection Regulation - GDPR.  I own and operate www.ellenjewettsculpture.com and www.etsy.com/shop/EllenJewettPrintShop.  I post my own original content, or content used with permission, on Facebook, Instagram, Pinterest, Flickr and Tumblr.

In this notice, you can read about the information that I, Squarespace, STRIPE, Etsy and Mailchimp collect from you and how it is used. This data collection is primarily automatic and for analytic purposes such as compiling statistics about what page is most popular, how users find each page, where globally most users are represented and what links get clicked.  If you have any questions or concerns, you can email me at el@ellenjewettsculpture.com

1. Squarespace

ellenjewettsculpture.com, its mobile site and applications are powered by Squarespace.  This website automatically saves certain types of data for technical reasons.

The information that may be collected includes:

  • The type of device you are using to view ellenjewettsculpure.com
  • Anonymous usage statistics
  • Information provided by Apple, which may include your name, email address and ZIP code
  • Anonymous information, such as your internet service provider, IP address and internet browsing software, collected by our website
  • “Cookies,” which enables the website to remember your information if you return to the site

2. Mailchimp

My notification list is used for providing consenting subscribers with information about upcoming sculptures for sale.  This list is administered through Mailchimp.  Users will only be subscribed to this mailing list by providing consent in the form of (1) voluntarily submitting their email through the opt in box on the ellenjewettsculpture.com website and mobile sites that is used only for this purpose or (2) by contacting me directly through email or etsy message with a personal request to be added.  I will never add you to this list based on unrelated emails, past purchases or other forms of participation with my business, this list is intended for voluntary consenting opt-in only.  Once subscribed Mailchimp will store some of your information, including your email address, IP address and certain information about the links you click within the emails I send you, on a Mailchimp server. Neither I nor Mailchimp will ever sell your email address or share it with any other party, unless we are legally compelled to do so. If you contact Mailchimp directly regarding your subscription to my lists, Mailchimp may contact you directly; otherwise, Mailchimp will never contact you. Only authorized Mailchimp employees have access to our subscriber list. You are always free to unsubscribe from the notification list, a unsubscribe option will be available at the bottom of every email.  Once unsubscribed you will no long receive future messages and your email address will be deleted.

3. Etsy

Analytics Information: Etsy uses data analytics to ensure site functionality and improve Services. Etys uses mobile analytics software to allow to understand the functionality of the Apps on your phone. This software may record information such as how often you use the Apps, what happens within the Apps, aggregated usage, performance data, app errors and debugging information, and where the Apps were downloaded from.  Etsy does not link the information stored within the analytics software to any personally identifiable information that you submit within the mobile application.

Non-Member Information: Etsy may receive or obtain information (for example, an email address or IP address) about a person who is not yet a registered Etsy or Etsy Studio member (a “non-member”) in connection with certain Etsy features, such as when a non-member chooses to subscribe to an Etsy newsletter, a member invites a non-member to visit the Site, a member uploads non-member information using the contact uploader feature, a non-member engages in a transaction, or a member sends a gift card code to a non-member, or a non-member uses the Guest Checkout feature when making a purchase through one of the Services. Non-member information is used only for the purposes disclosed when it was submitted to Etsy or to facilitate action authorized by the non-member.

4. STRIPE

When you make payments or conduct transactions through this website STRIPE will receive your transaction information. The information that STRIPE collects will include payment method information (such as credit or debit card number, or bank account information), purchase amount, date of purchase, and payment method. Different payment methods may require the collection of different categories of information. The payment method information that STRIPE collects will depend upon the payment method that you choose.  STRIPE will send me your billing and shipping information pertaining to each order so I can complete and ship your purchase, however payment information, such as credit card numbers are not shared.

5. How I use your information

I use your information only to complete operations necessary to produce and distribute purchased prints and sculptures from this website. I do not share your information with third parties except that which is collected automatically by those noted above, such as STRIPE, when it’s necessary to complete the purchase functions from ellenjewettsculpture.com

When you email me, I will use your email address only for the purpose of responding to you, and requests you make, and for no other purpose.  

Sometimes I may use anonymous analytic information about your use of this site in combination with other users’ usage to make decisions about the contents and design of ellenjewettsculpture.com.  

I will only disclose your information in response to subpoenas, court orders, or other legal process, or to establish or exercise our legal rights or to defend against legal claims.

I may disclose your information when I believe it necessary or desirable in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our policies, and/or to protect rights and property.

6. Data security

I use only well accredited named third parties, such as Mailchimp, Etsy and STRIPE that have systems in place to safeguard the information you provide to them. I will never provide access to my databases to any third party, except those that are named and only to the extent necessary to conduct the operations of this website.  

7. Data Retention

I retain your personal information only for as long as necessary to provide you with my services. When payments are processed the information is not given or stored by me, the service providers, Etsy and STRIPE, deal with your information directly.  However, I may be required to retain any information given to me to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. 

8. Children’s privacy

Per this Privacy Policy and Terms of Service, users certify that they are at least 13 years of age. I never collect or store information of anyone I know to be under 13, and Ellenjewettsculpture.com content is created for an adult audience.

9. Changes to this policy

I reserve the right to change this policy at any time. You are responsible for checking this page for changes. Your use of ellenjewettsculpture.com,www.etsy.com/shop/EllenJewettPrintShop and continued subscription to my mailing list constitutes agreement to this privacy policy.
